SENTENCING RANGES
The actual sentence can vary widely. Probation and Community Corrections are not included when the legislature decides the sentencing statutes. You need a lawyer to help determine the sentence. This page is not a substitute for a lawyer. The following charts show what sentence ranges are available to the Court if you are sentenced in the presumptive (normal) range.
Sentence aggravators will multiply your presumptive sentence range. For instance, a 4th class felony with a two to six year presumptive range can be aggravated to a minimum of 24 years. That’s a minimum. The judge can’t give you less even if he or she wants to. Aggravated sentencing is not addressed here.
You cannot begin on these charts without knowing the class of offense you are charged with. The statutes for each offense will define it as a “__ class felony” or “__ class misdemeanor.” The charging documents will also refer to class, using shorthand (“F5” for 5th class felony, “M2” for second class misdemeanor).
