You may be eligible for one, more, or none of the actions that I do.

To determine which option is right for your case, we must consider:

§         Different time requirements (deadlines)

§         Different remedies (a new trial or just a change in your sentence)

§         Different standards of proof (clear error, abuse of discretion, beyond a reasonable doubt, preponderance, a prima facie case, any showing).

Take the time calculation test here to see what you may qualify for.

If you are close to the cut-offs, call to set an appointment as soon as possible.

Have a better future- get your old case dismissed before you get punished for it.

You hear about cases being dismissed on technicalities. I find the opposite to be true: cases that should be dismissed are still around because of a technicality.  I have gotten many dismissed that should have been put down long ago.  They are usually old deferred sentences.  Often the DA and the defendant had agreed to dismiss the case after a certain period of time, but for some reason, it is still around.  Then, an employer or a landlord does a background check and finds it.  They don’t read all the fine print that says you complied with the deferred.  They simply skip over you to the next one in line.  If it should be dismissed, get it dismissed, and get on with your life.
