Appeals of Verdicts

  • Did you testify? Why or Why not?
  • Did the court fully advise you of your right to remain silent, or your right to testify?
  • Who decided whether you would testify or not?
  • What evidence was admitted?
  • What was said during testimony?

Appeals of Plea Agreements

  • In making the agreement, did you waive your right to appeal?
  • Did you make this waiver voluntarily, knowingly and intelligently?
  • Were you advised properly by the court?
  • Did you receive a sentence contemplated by the agreement?
  • Did the judge speak to you directly?
  • Did you understand every element of the offense you were pleading to?
  • Did your admissions establish a factual basis for the offense?

Appropriate Sentences

I will look to determine whether your sentence is excessive. That includes:

  • Prison
  • Jail
  • Parole
  • Community Corrections
  • Probation
  • Useful Public Service
  • Alcohol Counseling
  • Domestic Violence Counseling
  • Concurrent or Consecutive Sentences
  • The Denial of Work Release
  • The Consideration of Home Detention or Day Reporting

Probation Revocations

If you didn't comply with a condition of probation, you may have an excuse.

  • What conditions did you comply with?
  • Which conditions were you close to completing?
  • Do you have a job, or other responsibilities?

Employment Background Checks

In addition to forcing you to take lie detector tests and urine drug tests, employers are now conducting background checks on you. They contract with companies that offer a check of court records, then may fire you or discipline you if they find negative information about you. The trouble is, these companies generally don't go to the courthouse. They rely on someone else's findings, which can be, and sometimes are, wrong. If the information is either wrong or explainable - fight the employer's action. I can step in to contact your employer, look for the discrepancy, and help you straighten things out.
